Terms of Service

These Terms of Service ("Terms") govern your access to and use of CMA Studio ("Service"), operated by CMA Studio ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

2. Description of Service

CMA Studio is an invitation-only web application that provides AI-powered Comparative Market Analysis (CMA) report generation and contact profile research for real estate professionals. The Service integrates with third-party lead management platforms via webhooks and uses artificial intelligence to generate reports.

3. Account Registration and Access

Access to CMA Studio is by invitation only. You must be invited by an existing administrator to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to generate misleading, fraudulent, or deceptive content
  • Share your API tokens or account credentials with unauthorized third parties
  • Exceed reasonable usage limits or abuse the webhook system

5. API Tokens and Webhooks

API tokens are provided for authenticating webhook integrations. You are responsible for securing your API tokens. Tokens should be treated as sensitive credentials. We reserve the right to revoke tokens that are used in violation of these Terms or that pose a security risk.

6. AI-Generated Content

Reports generated by CMA Studio are produced using artificial intelligence and are intended as informational aids. AI-generated content may contain inaccuracies and should not be relied upon as the sole basis for real estate decisions. You are responsible for reviewing and verifying all generated content before using it in any professional or client-facing context.

7. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by CMA Studio and protected by intellectual property laws. Reports generated through the Service using your data are owned by you, subject to our license to process and store them as necessary to provide the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the data practices described in the Privacy Policy.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CMA PAGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately, though provisions that by their nature should survive termination will remain in effect.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
